Petitioner contends no narcotics was seized from his possession. He has been implicated in the matter on the statement of co-accused before police officer which is inadmissible in law. Accordingly, he prays for anticipatory bail. 2.

Learned Advocate for the State contends on prior information a truck was detained.

We have considered the materials on record. 417 kgs. of ganja were recovered from the truck. A person was standing at the point of delivery. He disclosed a vehicle had been loaded with ganja from Dinhata. The complicity of the petitioner transpired in the course of the investigation. Custodial investigation to reveal the ramifications of the crime is necessary. 4.

Keeping in mind the aforesaid facts, we are not inclined to grant anticipatory bail to the petitioner.
