Pratima Pandey Nee Shukla v. State Of West Bengal & ANR.
12.07.2021
IN THE HIGH COURT AT CALCUTTA
Item No.27 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.
C.R.R. 264 of 2012 (Via Video Conference) Smt. Pratima Pandey nee Shukla versus The State of West Bengal & Anr.
In Re: An Application under Section 482 of the Code of Criminal Procedure.
The present revisional application has been preferred against the order dated 06.01.2012 wherein the Chief Metropolitan Magistrate, Calcutta was pleased to reject the prayer for cancellation of bail of the present petitioner (de facto complainant). Records reflect that the subject-matter of the case relates to New Market P.S. (D.D.) Case No. 288 of 2011 dated 19.07.2011 under Sections 498A/406/34 of the Indian Penal Code (corresponding to G.R. Case No. 2518 of 2011).
I have perused the order passed by the learned Magistrate and I find that the learned Magistrate, on appreciation of the records, was pleased to reject the prayer of the de facto complainant for cancellation of bail. The revisional application was preferred in the year 2012 and since then, the matter is pending before this Court. I do not find any special circumstances to interfere with the order of bail after more than nine and a half years. Accordingly, CRR 264 of 2012 is dismissed.
All pending applications, if any, are consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
