(Through Video Conference) WPA No. 3247 of 2021 Nadim Raza Vs.

CESC Limited and another Mr. Indranil Halder ... for the petitioner.

Mr. Somnath Bose ...for the CESC Limited.

Learned counsel for the petitioner urges that the CESC Limited is not giving new connection to the petitioner, despite the petitioner's application for that purpose.

However, it appears, upon hearing learned counsel for the parties, that the CESC Limited has raised a specific dispute as regards apprehended splitting of load in the event such connection is given. Since there is a mechanism under the law for addressing such disputes, WPA 3247 of 2021 is dismissed as not maintainable with liberty to the petitioner to approach the Grievance Redressal Officer (GRO) with the issues as taken in the present writ petition.

It is made clear that the merits of the respective contentions of the parties have not been gone into by

this Court and it will be open to the competent authorities to decide the matter in accordance with law without being influenced by any of the observations made herein.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
