The present appeal was preferred against the judgment and order of acquittal and the appellant on his oath has stated that on his personal reason he do not intend to pursue the appeal. Having regard to the contentions advanced by the learned advocate appearing for the appellant along with the affidavit, I direct that CRA 38 of 2021 be dismissed as not pressed. Pending application, if any, is consequently disposed of. Department is directed to send back the lower court records immediately.
