The petitioner submitted a representation before the concerned authority in this regard on July 15, 2024 which is yet to be considered. The petitioner seeks consideration of the same. No affidavit/report has been submitted by the respondent authorities as sought. The respondents have no objection if the representation submitted by the petitioner is directed to be considered by the Block Development Officer, Chanchol -I. The matter involves several factual aspects which need to be dealt with by the concerned authority.
In view of the above, the writ petition is disposed of directing the Block Development Officer, Chanchol -I, being the 7th respondent herein, to consider and dispose of the representation submitted by the petitioner on July 15,
2024 within four weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioner and the private respondent, in accordance with law.
The parties shall be at liberty to place all the documents in support of their respective contention before the concerned authority at the time of hearing. The decision taken by the authority shall be communicated to the parties within a week thereof. The writ petition is disposed of.
There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
