1. Affidavit-of-service filed in Court today be taken on record.

2. The petitioner has applied for intra district transfer, inter alia, on medical ground and on the ground of distance of 40 kilometers from her residence.

3. In such circumstances, the Chairman, District Primary School Council, Bankura shall refer the petitioner's case to Chief Medical Officer of Health, Bankura. After obtaining the opinion of the C.M.O.H, and if the same confirms that the petitioner cannot travel the distance of 40 kilometers from her residence, the District Primary School Council, Bankura may consider the petitioner's case for transfer.

4. The aforesaid consideration shall be subject to availability of vacancy and the pupil-teacher ratio in the existing Schools. However, the availability of extra teacher in nearby Schools may also be considered.

5. Let the aforesaid exercise be completed within a period of one month from the date of receipt of a copy of this order offline.

6. With the aforesaid directions, the instant writ petition shall stand disposed of.

7. There will be no order as to costs.

8. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
