The present revisional application was preferred for expeditious disposal of Jamuria Police Station Case No.129 of 2009 dated 23.05.2009.
Mr.
Pravas Bhattacharya, learned advocate, who ordinarily appears on behalf of the State, is directed to represent the State. His appearance may be regularised by the concerned authorities.
Records of the revisional application reflect that the accused persons were evading the court and on 19.12.2022 the learned Judicial Magistrate, 2nd Court, Asansol was pleased to direct the accused persons to be present on 20th July, 2023 for framing of charges, in default warrant of arrest should be issued. In view of the order dated 19.12.2022 and the records reflecting the delay of 13 years, I direct that the Inspector-in-Charge of Jamuria Police Station will take additional measure of ensuring the presence of the accused persons on the date so fixed for consideration of charge. The learned trial court after the charge is framed would fix at least two dates in a month so that the trial of
the case can be taken to its logical conclusion within a reasonable period of time.
With the aforesaid observations, CRR 408 of 2023 is disposed of.
Mr. Bhattacharya, learned advocate appearing for the State would communicate this order to both the Inspector-inCharge of Jamuria Police Station as well as the learned trial court. Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
