1. Affidavit of service is taken on record.

2. The present writ petition has been filed by the Petitioner challenging the inaction of the respondent in not granting the dependent pension arising out of Swatantrata Sainik Samman Pension Scheme 1980 formerly known as Freedom Fighters' Pension Scheme 1972.

3. It is the case of the petitioner that her late husband Sh. Taimur Ali Shah was a freedom fighter and was in receipt of pension under the above-mentioned scheme.

He expired on 24.6.2016.

However, despite repeated representations and follow up, the respondent failed to extend the benefit of the said scheme to the widow of late Sh. Taimur Ali Shah.

4. Being aggrieved, the petitioner has preferred the present writ petition.

5. Learned ASGI for the respondents at the outset fairly submits on instruction that they shall

release the pensionary benefits to the petitioner within six weeks.

6. In view of the said statement, learned counsel for the petitioner does not wish to press the present writ petition.

7. The respondent shall be bound by the statement made by the Ld. ASG.

8. In view thereof, the present writ petition is disposed of in terms of the statement made by the Ld. ASG before this court. The respondent shall release the pensionary benefits to the petitioner within a period of six weeks from the date of communication of this order.
