Leave is granted to the petitioner to add South Dum Dum Municipality as a party to the proceeding in course of today.

Heard the parties through their respective counsels.

In the instant case the petitioner is an intending operator of an Auto Rickshaw route from Ramkrishna Mahaswashan Ghat to Dum Dum Station.

The petitioner already made an application before the authority concerned to consider the feasibility of creating a new Auto Rickshaw route from Ramkrishna Mahaswashan to Dum Dum Station. The said representation was not considered and remained pending for consideration. Thereafter, the petitioner filed a writ petition for consideration of the representation.

The petitioner submits that this is the third round of litigation to consider the issue for creation of the new Auto route in question.

The petitioner draws the attention of the decision dated 04.07.2024 of the respondent no. 4 that holding, inter alia, no new auto rickshaw route can be considered in the said area since there exists a huge traffic congestion.

Learned advocate for the respondent authorities submits that there is no adequate space for parking the new Auto rickshaw.

In view of the above, the petitioner is directed to identify an alternative space for parking of the auto rickshaw from Ramkrishna Mahaswashan to Dum Dum Station and shall communicate the same to the respondent no. 4. The respondent no. 4 with the assistance of the Municipal Authority of South Dum Dum shall consider the feasibility of the same and arrive at a logical conclusion within a period of 30 days from the receipt of the communication from the petitioner and accordingly the decision shall be communicated within two weeks thereafter to all the concerned parties.

It is made clear the respondent no. 4 is also directed to approach the Chairman, Regional Transport Authority for taking a logical stand for parking of the vehicles.

The writ petition being WPA 2951 of 2025 is accordingly disposed of.

There will be no order as to costs.

All parties shall act on the server copy of the order duly downloaded from the official website of this Court.
