Kakali Das v. State Of West Bengal And ORS.
21.09.2022 Sl. No.110(DL) srm W.P.A. No. 2642 of 2022 Smt. Kakali Das Vs.
The State of West Bengal & Ors.
Mr. Subhasish Mitra ....for the Petitioner.
Mr. Susanta Pal, Mr. Prabir Kumar Ray ...for the State-respondents.
Supplementary affidavit and affidavit-of-service filed by the petitioner, are taken on record. The writ petition was filed alleging that the Gopalnagar Gram Panchayat, District-Hooghly had not considered the application of the petitioner for revalidation of the sanction plan, which had lapsed during the Covid-19 pandemic. The petitioner was not able to construct the building within the validity of the plan. It appears that the panchayat authorities by a letter dated February 25, 2022 directed the petitioner to file certain documents including two copies of the blueprint of the plan, which was to be prepared by maintaining the statutory rules. Details have been provided in the letter.
The writ petition is disposed of, granting liberty to the petitioner to approach the Gopalnagar Gram Panchayat with the copies of the blueprint of the plan and other documents in terms of the letter dated February 25, 2022. If the petitioner complies with the requirements as per the said letter, the panchayat authorities shall grant necessary permission, in accordance with law. The entire exercise must be completed within 6 weeks from receipt of the documents from the petitioner and upon compliance of necessary formalities by the petitioner.
This Court has not gone into the merits of the claim and counter-claim of the parties.
The writ petition is, thus, disposed of.
There shall be no order as to costs.
Parties are to act on the basis of the server copy of this order.
