The petitioner complains that the private respondents have been cutting the trees in her premises and have also assaulted and outraged her modesty when she protested.

On the complaint of the petitioner, Duttapukur Police Station has registered an FIR against the five persons being No. 724 of 2021 dated 26th August, 2021.

It appears from the records that investigation is completed and charge-sheet No. 851 of 2021 dated 30th September, under Sections 341/323/354/506/34 of the Indian Penal Code has been filed.

The petitioner thereafter has filed several applications before the learned Executive Magistrate, Barasat and proceeding under Section 107 of the Code of Criminal Procedure has been taken out against the private respondents.

There is clear and prima facie evidence before this Court of misconduct and misbehaviour by the private respondents.

The Officer-in-charge, Duttapukur Police Station shall, therefore, ensure that there is absolutely no breach of peace in the area and a police picket comprising of two constables be posted by the Duttapukur Police Station for a period of two weeks in the locale.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
