Praveen Kumar Prem Chand Mr. Devajyoti Barman ... for the petitioner Ms. Sanjukta Basu Mallick ... for the opposite party It is submitted that the superintending power of this court should be invoked in order to enable the wife/petitioner to appear virtually on the date fixed for hearing of the application for divorce on mutual consent.

The husband who is represented by his learned advocate also supports such prayer on the ground that the husband will appear physically before the learned court, but the wife who is undergoing her studies in Spain, be allowed to appear virtually before the learned court.

A joint prayer be filed by the parties within May 9, 2024 before the learned court, namely, the Additional District Judge, Fast Track 4th Court at Barrackpore, North 24 Parganas, with such prayer. The learned judge shall make arrangements for virtual appearance of the wife/petitioner, either by video call or through any other virtual mode available.

Since it is a joint application for divorce filed under the appropriate law, the learned court shall proceed accordingly, considering the inconvenience of the wife to come to India leaving behind her work and studies, which she is pursuing abroad. The convenient time shall be fixed by the learned court as per the court's schedule as also convenience of the parties.

The revisional application stands disposed of accordingly.
