Learned counsel for the petitioner argues that, due to obstruction being created by the private respondent no.5 and or his men and agents, the WBSEDCL personnel are not being able to give a new electric connection to the petitioner.

Despite service, none appears for the private respondent, although the petitioner and the WBSEDCL are represented through counsel.

Affidavit-of-service filed in court today be kept on record.

In view of the allegations made by the writ petitioner, WPA 2647 of 2022 is disposed of by directing WBSEDCL to give a new electric connection to the petitioner, subject to compliance of all formalities at the end of the petitioner, as expeditiously as possible,

preferably within three weeks from date and/or from the date of compliance of all formalities, whichever is later. In the event any obstruction is created by the private respondent no.5 and/or his men and agents at the time of the WBSEDCL personnel giving such connection, it will be open to the said personnel to approach the Inspector-in-Charge of the Joynagar Police Station (respondent no.4).

If so approached, the respondent no.4 shall grant adequate police assistance at the cost of the petitioner for ensuring due compliance of this order.

In the event any padlock is put up to prevent the access of the WBSEDCL personnel to the existing meter board position, it will be open for the police personnel to break open such padlock.

The parties shall act on the written communication of the learned Advocates for the parties, coupled with server copies of this order, without insisting upon prior production of a certified copy thereof.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
