It is submitted that though argument of the suit fixed but no argument heard by the Court.

Considering the facts and circumstances, I do not find any reason to ask the petitioners to serve notice upon the opposite parties. Thus, service of notice upon the opposite parties stands dispensed with.

I have perused the orders filed in this case and I do not find any laches on the part of the Court for delay. However, the Other Suit No.17 of 1981 along with Title Suit No.97 of 1999 has already been fixed for argument, so I request the learned Additional District Judge, 1st Court, Howrah, to hear the argument on the next date fixed therefor, without granting any unnecessary adjournment to any of the parties to the suit and deliver judgment at the earliest.

With the aforesaid observation, the revisional application, being CO 388 of 2023, stands disposed of. Learned advocate appearing on behalf of the petitioners is at liberty to bring this order to the notice of the learned Additional District Judge, 1st Court, Howrah, forthwith.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
