1. The appellants are not represented nor any accommodation is prayed for on behalf of the appellants. Even on earlier occasion the appellants were not represented.

2. In terms of our earlier order, we propose to decide the said application on the basis of the materials available with the record.

3. However, having regard to the report of the Additional Stamp Reporter, the appeal is delayed by 91 days in as much as this appeal is not maintainable in this Court. In view of the provision laid down in Section 21 (1) (a) of the Bengal, Agra and Assam Civil Courts (West Bengal Amendment) Act, 2000.

4. In view thereof, the appeal and the applications stand dismissed as non maintainable without going into the merits of the case.
