The petitioner seeks the demolition of a building located at 91/24A, Bose Pukur Road, Ward No. 91, Borough - X, P.S. Kasba, Kolkata - 700 042.

The petitioner alleges that he entered into a development agreement with Respondent No. 8.

However, Respondent No.

has undertaken construction without a sanctioned plan and has failed to allocate the petitioner's share as agreed upon. The Corporation has filed a report, which indicates that a demolition order has been issued in respect of the building in question. However, the Corporation was unable to complete the demolition due to resistance from the current occupiers of the

building.

In light of the foregoing, no further issues remain to be decided in this writ petition. The Corporation is at liberty to complete the demolition proceedings in accordance with the law.

Accordingly, WPA 2741 of 2023 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
