Mukherjee ..for the Jadavpur University Learned Counsel appearing for the State submits the reports dated 18th December, 2020 and 5th January, 2021. Perused both the reports.

Mr. Basu, learned Counsel appearing for the petitioner relies on the reports of the State and prays for a direction so that the content of the reports can be acted upon by the University.

Mr. Kar, learned senior Counsel appearing for the University submits that the reports recorded herein, should be confined to the writ petitioner only and liberty be given to the University to restore the seniority as it was being done traditionally.

Heard all the parties.

From the reports of the Principal Secretary, Higher Education Department, Government of West Bengal it is clear that Professor Amitava Gupta ,the petitioner herein,

is the next seniormost teacher in the list of seniority after Dr. Amitava Datta.

Under the above pretext, Vice Chancellor, Jadavpur University is requested to act on the reports and to appoint the petitioner as the Head of the Power Engineering Department of the University as early as possible preferably within a period of three months from date.

I make it clear that this order cannot be treated as a precedent on the other teachers of the University. Reports dated 18th December, 2020 and 5th January, 2021 filed by the State be kept with the record. With the above direction, WPA 2006 of 2020 is disposed of.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on the usual undertakings.
