The application for anticipatory bail under Section 438 CrPC has been filed apprehending arrest in connection with Basanti P.S. Case No. 549 of 2020 dated 11.09.2020 under Sections 147/148/149/307 of the Indian Penal Code and Sections 25/27 of the Arms Act.

It is submitted by the counsel for the petitioner that out of 15, 14 accused persons have already secured bail. Counsel for the State submits that other 14 accused persons were allowed bail after surrender and the petitioner has been absconding.

This court is therefore not inclined to entertain the application under Section 438 CrPC and same stands dismissed. The parties shall act in terms of the copy of the order downloaded from the official website of this court. (Biswajit Basu, J.) (Rajasekhar Mantha, J.)
