PP Mr. Arijit Ganguly Mr. Anindya Sundar Chatterjee ...for the State This is an application seeking an expeditious disposal of a proceeding in which a charge-sheet was submitted under Section 21 (c ) of the NDPS Act. Let a copy of this application be served upon Mr. Arijit Ganguly and Mr. Anindya Sundar Chatterjee, learned advocates who are present in Court today and who ordinarily appear on behalf of the State. Their engagement may be regularised in due course by the competent authority of the State.
Learned counsel for the petitioner submits as follows. The petitioner is an accused in this case. He is in custody since 09.02.2021 the date on which the FIR was lodged. Charge-sheet was submitted in April 2021. Charges were framed thereafter. Till date, out of 8 witnesses, only 2 witnesses have been examined. However, on the last occasions, none of the witnesses
appeared. The proceeding has remained pending for no fault of the present petitioner.
Learned counsel for the State submits that no inordinate delay has been caused in this case. I have heard the submissions of the learned counsels appearing on behalf of the petitioner and the State and have perused the revision petition. It does not appear that an inordinate delay has taken place in disposing of the proceeding. For an FIR that was lodged in April 2021, two witnesses have already been examined.
Therefore, there is no need to pass any order directing expeditious disposal of the proceeding. However, it is expected that the learned trial Court would conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties and by taking coercive measures, if necessary, to ensure the attendance of the witnesses.
With these observations, the revisional application is disposed of.
