Versus

The State Bank of India and others Mr. Purnasish Gupta, Mr. Jayanta Kr. Mukhopadhyay ... for the petitioner.

The only dispute before the court is the Bank not disbursing the eligible dues of the three legal heirs of the deceased account holder/pensioner since the parties are not complying with the formalities prescribed by the Bank.

The petitioner is one of the legal heirs and claims 1/3rd share of the amount lying in the account of the deceased pensioner. The private respondent nos.4 and 5 are the other two legal heirs. The respondent no.4 is represented while the respondent no.5 is not represented despite being served.

Since it is obvious that the petitioner as well as the two other legal heirs will not get their respective 1/3rd shares in the absence of complying with the requisite formalities which is, in this case, the submission of

Succession Certificate as well as furnishing of other documents in the due format, W.P.A.2759 of 2023 is disposed of with a direction on the petitioner and the two private respondents to comply with all requisite formalities with regard to submission of Succession Certificate as well as the other documents in the format as required by the Bank.

The Bank shall inform the petitioner and the two private respondents of the formalities within a week from date. The petitioner and the private respondents shall comply with these formalities within the timeframe, as advised by the Bank.

Needless to say, the documents which are presently lying with the private respondent no.4 shall be made over to the Bank for due compliance of the requisite formalities. In the event, the respondent no.4 has already taken steps as directed, the respondent no.4 shall do the same upon speaking with the concerned official of the Bank.
