Heard learned counsels for the parties.

The sole grievance of the petitioner is that the bank forcibly adjusted the loan taken by his father from the maturity value of the fixed deposit of the petitioner. The petitioner lodged a complaint before the police authority which was not acted upon.

The bank has denied and disputed the allegation of the petitioner.

Upon consideration of the submission made on behalf of the parties, this Court is of the view that in the event the petitioner is aggrieved by the police authority not registering FIR pursuant to his complaint, he is at liberty to approach the jurisdictional Magistrate under Section 175 of the BNSS.

With the above direction, the writ petition is disposed of.

There shall however, be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
