Pursuant to the earlier direction, a report has been received from the Learned Registrar (Judicial Service), High Court, Calcutta which is enclosed with the reports of the learned District Judge as well as learned Judicial Magistrate, 10th Court, Alipore.

The report prepared by the learned Judicial Magistrate, 10th Court, Alipore reflects that a sum of Rs.35,000/- was deposited against monthly maintenance

amount of Rs.15,000/- per month as was passed in AC 1529 of 2023. The learned Court after the deposit being made was pleased to recall warrant of arrest and released the private respondent.

Having considered that the steps which have been taken by the learned Magistrate were inconsonance with the provisions of law and by exercising judicial discretion, I am of the view that no interference is called for.

The records of the case speak that the next date has been fixed in the 3rd, April, 2025. The learned Magistrate, henceforth, will proceed in accordance with law.

However, the petitioner is granted liberty to take steps before the learned Judicial Magistrate, 10th Court, Alipore in connection with the Execution Case as well as the original case being AC 1529 of 2023.

It is further directed that in case any deposit is made, the same should be reflected in the order of the learned trial court so that petitioner be acquainted with the same.

With the aforesaid observations, WPA 2985 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
