1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. Petitioner made an application for transfer on portal on 25th May, 2022. However, petitioner was found to be single teacher in the subject in the school. Transfer application was forwarded by the school authority of the petitioner on 25th May, 2022 but concerned District Inspector of Schools on 29th May, 2022 sent back the transfer application to the school authority. It is submitted by learned advocate representing the petitioner that in terms of Government

Order dated 3rd January, 2022 concerned District Inspector of Schools (SE) is required to take steps for providing local arrangement in the school of the petitioner in order to facilitate petitioner's transfer. It is also submitted school authority of the petitioner has found a teacher from neighbouring school who can be deputed in place of the petitioner after petitioner's transfer.

Respondents are represented by learned advocates who have jointly submitted that in terms of Government Order dated 3rd January, 2022 it is the duty of the concerned District Inspector of Schools to find out a teacher of neighbouring school who can be deputed in place of petitioner after petitioner's transfer.

Having considered the respective submissions made on behalf of the parties, District Inspector of Schools (SE), Howrah being respondent no. 7 is directed to make endeavour to find out a teacher of neighbouring school who can be deputed in place of petitioner after petitioner's transfer in terms of Government Order dated 3rd January, 2022. If school authority of petitioner has found a teacher from neighbouring school respondent no. 7 shall also consider whether that teacher can be deputed

in the school of the petitioner or not for transferring the petitioner. If teacher of another school is deputed in the school of the petitioner, petitioner shall be transferred immediately thereafter in accordance with law.

5. Writ petition stands disposed of.

6. There shall be no order as to costs.

7. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
