Petitioners Mr. Aviroop Bhattacharya ...for the petitioners Ms. Shaila Afrin Ms. Manasi Roy ..for the State Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners have been falsely implicated in this case. There are case and counter case.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. She relies on the injury report and the statements of victim and the other witnesses. She submits that at least two of the petitioners namely Kush Singh @ Kush Kumar Singh and Subham Bahadur (the petitioner nos. 1 and 2) have criminal antecedents of similar nature against them. In the present case, the petitioners were consuming alcohol inside a temple. When the victim protested, he was severely assaulted including on a vital part of the body like scalp, which required stitches for repair. Considering the above and the other incriminating materials available in the case diary, I do not consider that this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioners is rejected.
