This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by inaction on the part of the respondent authorities in considering his representation dated September 27, 2019 for grant of higher scale of pay. Learned counsel for the petitioner submits that similarly placed persons have been granted the benefit by the Director (MME), department of Mass Education Extension, West Bengal by order dated January 29, 2018. I have heard learned counsel for both parties and perused the materials on record.

In my view, the representation of the petitioner should not be kept hanging, and the same should be looked into and a reasoned order passed in accordance with law to finalise this issue with respect to the writ petitioner.

Accordingly, the Director (MME), Department of Mass Education Extension, West Bengal is directed to grant an opportunity of hearing to the writ petitioner and consider his representation dated September 27, 2019 in accordance with law and to pass a reasoned order within a period of six weeks from the date of communication of this order. The reasoned order should be communicated to the writ petition within two weeks of passing of the same.

Writ petition being W.P.A. 2073 of 2020 is disposed of. There shall be no order as to costs.

Since no affidavits have been invited, the allegations contained in the writ petition are deemed not to have been admitted by the respondents.
