Learned advocate for the petitioner complains that the petitioner is in custody for two years two months yet till date only two witnesses have been examined out of cited 22 witnesses. Learned advocate for the State opposes the prayer for bail and submits that the subject matter of the case involves 17 1⁄2 bhoris of gold. The earlier order dated 24.06.2025 in CRM (M) 596 of 2025 reflects that at that stage it was submitted on behalf of the State that vulnerable witnesses were yet to be examined. Having considered the gravity of the offence, I direct the State to submit the list of vulnerable witnesses to the Court on the next date fixed before the learned Trial Court. Learned trial Court would complete the examination of vulnerable witnesses within a period of three months from the next date so fixed.

Learned trial Court would, if required, prepone the dates and organise the number of schedule for completion of vulnerable witnesses. At this stage, however, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM (M) 393 of 2026 is dismissed with the aforesaid directions. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
