Affidavit of service filed by the petitioner is taken on record.

The petitioner claims to have stepped into the shoes of the recorded lessee Anjali Chaudhuri who was his wife who expired on 14th April, 2018.

Learned counsel for the petitioner submits that the petitioner applied for mutation of the property in question before the concerned authority as sole legal heir of the erstwhile lessee, but the said application is yet to be disposed of. The petitioner prays for a direction upon the authority to consider the representation at the earliest.

Upon consideration of the submissions made on behalf of the parties, the writ petition is disposed of directing the 2nd respondent to treat the writ petition as representation of the petitioner and consider and dispose of the same within one month from the date of communication of this order after giving reasonable

opportunity of hearing to all the interested parties including the petitioner or his authorities representative, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof.

The petitioner is directed to serve a copy of the order along with a copy of the writ petition to the 2nd respondent at the earliest.

With the above observations and directions, WPA 2691 of 2022 is disposed of. There shall however, be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
