Mr. S.P. Lahiri Mr. R. Naskar ..for the petitioner Mr. Supriyo Chattopadhyay, Ld. AGP Ms. Sayantanee Bhattacharya ..for the State Affidavit of service filed on behalf of the petitioner is taken on record.

Learned counsel appearing for the petitioner submits as follows. The petitioner is an Assistant Teacher in a school while his wife works in the Indian Railway. Both of them draw HRA. However, at present the HRA of the petitioner's wife has crossed the ceiling limit for the two. In all his fairness, the petitioner should be entitled to proportionate amount of the HRA. A representation dated 15.07.2022 in this regard has been made to the respondent no.3, but has not been replied as yet.

Learned counsel for the State submits that if representation is pending before the respondent no.3 the same shall be considered in accordance with law. It appears that the representation dated

15.07.2022 is pending before the respondent no.3 for consideration.

In view of the same, let the representation dated 15.07.2022 of the petitioner be considered by the respondent no.3 in accordance with law and as expeditiously as possible, preferably within a period of six weeks from the date of communication of this order. Within a week thereafter, the outcome of such consideration shall be communicated to the petitioner. With these directions and observations, the writ petition is disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
