The application for special leave to appeal was filed challenging the judgment and order of acquittal in a proceeding under Section 138 of the Negotiable Instruments Act.

It is needless to say that an offence under Section 138 of the N.I. Act has been made compoundable. Since the parties have amicably settled the dispute between themselves and the appellant does not want to proceed with the instant appeal, the appeal be dismissed for non-prosecution on the prayer of the appellant.
