Petitioner has approached this court as the information furnished on or about 30.12.2022 to the Officer-in-charge, Chandipur Police Station did not yield any result. Petitioner's grievance is that the custody of the minor child was taken away by his father and the death of the petitioner's daughter. State has submitted a report which reflects that the petitioner's grandson was in the custody of the father who is being taken care of. So far as the other subject matter is concerned, relate to the death of the petitioner's daughter it is reflected from the post-mortem report that "Death was due to effects of diseased condition of kidney-as note aboveante mortem in nature". Having regard to the fact that the incident complained of is of the year 2022 and so far as the custody is concerned, the child is under a lawful

custody, if the petitioner intends to invoke any jurisdiction, petitioner would be at liberty to invoke the jurisdiction of the civil court under the relevant provisions of law. So far as the issues relating to death of the daughter is concerned the U/D Case No.

68/2022 dated 13.11.2022 was already registered and the report of the medical expert is there.

Considering the same, I am of the view that no interference is called for as the police authorities had acted adhering to the provisions of law.

With the aforesaid observations WPA 2797 of 2023 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
