The instant appeal has been filed against an order of acquittal passed on 18.06.1997 passed by the learned Senior Municipal Magistrate, Calcutta acquitting the accused in Case No. 8D of 1987 under Section 7, 16 of the Prevention of Food Adulteration Act. The report submitted by the Bhowanipore Police Station dated 29.11.2023 along with a copy of the death certificate stated that the respondent i.e. Sudhindra Nath Roy has expired on 06.10.2009. Let the said report be kept on record.

Under the facts and circumstances, the instant appeal gets abated and disposed of accordingly.
