Learned counsel for the petitioner submits that although there was initially a dispute with the private respondent regarding the petitioner being given a new electricity connection, subsequently consent in that regard has been given by the private respondent. Accordingly, a proper application for new connection has been filed by the petitioner.

Learned counsel for the WBSEDCL submits that initially no application in proper format was filed by the petitioner.

However, in the event a proper application is now filed by the petitioner upon compliance of all due formalities in law, the WBSEDCL shall process the application and give the connection, if otherwise feasible. In view of such submissions, although the service of the writ petition on the private respondent has not yet been completed satisfactorily, no further service is

directed on the private respondent since the order proposed to be passed is innocuous and does not affect adversely any right of the private respondent. Written instructions filed by learned counsel for the WBSEDCL be kept on record.

WPA 2819 of 2023 is, thus, disposed of by directing the WBSEDCL to process the application filed by the petitioner for new electricity connection, if so filed, and to give such connection to the petitioner as expeditiously as possible, preferably within a week from the compliance of all due formalities by the petitioner.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
