Learned counsel for the petitioners submits that all the flat owners in the apartment-in-question are ready and willing to file a joint application for getting domestic electricity connection from the West Bengal State Electricity Distribution Company Limited (WBSEDCL).
Learned counsel for the WBSEDCL, in his usual fairness, reiterates his submission that if such a joint application is made, the WBSEDCL shall process the same, of course, subject to compliance of due formalities by the flat owners for giving such connection to the petitioners in each of the matters. Accordingly, all the writ petitions, bearing WPA No. 2733 of 2022, WPA No. 2737 of 2022, WPA No. 2739 of 2022, WPA No. 2740 of 2022, WPA No.
2745 of 2022, WPA No. 2748 of 2022, WPA No.
2751 of 2022 and WPA No. 2754 of 2022, are disposed of with liberty to the petitioners to apply jointly along with other flat owners of the apartment, if any, as per due legal procedure for getting domestic electricity connection from the WBSEDCL.
If such an application is made jointly, the WBSEDCL shall process the same expeditiously
and, subject to compliance of due formalities by the joint applicants, the WBSEDCL shall give such connection at the earliest, preferably within three weeks from date of compliance such formalities. It is made clear that the order is being passed on the basis of the fair stand taken by the WBSEDCL, keeping in view the hardship being faced by the flat-owners, and the consent of the parties. However, this order will not be treated to be a precedent on any proposition of law for future reference.
There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
