In The High Court At Calcutta Constitutional Writ Jurisdiction Appellate Side W.P.A 3407 of 2021 Md. Jamil Akhtar -versus State of West Bengal & Ors.

Mr. Sabyasachi Chatterjee, Mr. Avik Ghatak, Mr. Soham De Dhara.

...For the Petitioner.

Mr. Malay Kumar Singh, Mr. Sajal Kumar Pandit.

...For the State.

Mr. Upendra Roy, Mr. Md. Mustafa.

...For the Proforma Respondents.

The petitioner participated in the recruitment process conducted by the West Bengal Board of Primary Education in the year 2020. He claims that he was present at the interview which was held on 10th January, 2021 at Bagbazar Multipurpose Girls' School. The said averment of the petitioner is categorically denied by the West Bengal Board of Primary Education. However, as the Board submits that it is practically impossible, within a short span of time, to verify as to whether the petitioner was actually present in the interview on 10th January, 2021 accordingly, the Board will grant a further opportunity to the petitioner to appear in the interview.

As the Board has already agreed to conduct an interview for the petitioner, let the time, date and venue of the interview be intimated to the candidate and the learned advocate for the petitioner in advance. The candidate shall attend the interview along with all testimonials/documents in original and photocopies thereof in support of his candidature. The Secretary of the Board shall take necessary steps in the matter in accordance with law, at the earliest, in the event the petitioner qualifies in the interview.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
