APP Mr. Amanul Islam ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody from 25th October, 2025 and has been arrested only on the basis of statement of a coaccused. Learned advocate for the State opposes the prayer for bail and submits that there has been recovery of 741 bottles of phensedyl.

However, so far as the complicity of the present petitioner is concerned, the contentions of the petitioner could not be refuted.

Learned advocate for the State is present and submits that the petitioner has an antecedent.

I have taken into account the totality of the circumstances and that similarly placed other accused persons who have been enlarged on bail in CRM (NDPS) 168 of 2026.

Having considered the same, I am of the view further incarceration of the present petitioner is unwarranted.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Palash Roy @ Polash Roy shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court under NDPS Act-cumAdditional District Judge, 5th Court, Berhampore, Murshidabad.

If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court and shall not leave the district of Murshidabad without prior intimation to the learned Special court.

Additionally, it is directed that the petitioner will meet with the Inspector-in-charge of Sagarpara Police

Station once in every ten days till further orders of this court.

Accordingly, CRM(NDPS) 263 of 2026 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
