Report states that General Dairies lodged by the petitioner complaining of threat was enquired into. Only one resulted in a prosecution under Section 351 (2), BNS. Private opposite party was enlarged on bail by the learned Sessions Judge on October 13, 2023.

Out of 19 charge sheeted witnesses, one was examined at the trial.

Post bail misconduct is of a nature that in our view do not require cancellation of the bail granted excepting clarifying and modifying the conditions of bail as hereinafter. We clarify that one of the conditions granting bail to the private opposite party to mean that the private opposite party will not enter the area of the police station where the police case stands registered.

Private opposite party will also not contact any of the prosecution witnesses either physically or in any manner including electronic form.
