A report has been submitted, which reflects that warrant of arrest is pending against the accused nos. 14 and 16.

The subject-matter of Chopra P.S. Case No. 38 of 2006 dated 09.03.2006 relates to alleged offence under sections 147/148/149/447/379/506/34 of the IPC. In view of the passage of 17 years having been passed, the inspector in charge is directed to submit a report within a week before the ld. Jurisdictional court regarding the accused persons, who are alive and, in case, any of the accused persons has died, a report, to that effect, be submitted along with the death certificate after proper enquiry.

So far as the witnesses are concerned, the availability of those witnesses whether they are alive or not, should be submitted before the ld. Jurisdictional court within the same period.

The warrant of arrest so pending be executed and the accused persons be granted interim bail by the ld. Trial court. The ld. Trial court would see to that the process of consideration of charges are completed by 20th of April, 2024, if after consideration of charges, the ld. Court is of the opinion that the trial of the case should proceed having regard to the nature of the allegations, then, the trial of the case should proceed on day to day basis till the evidence of the prosecution is completed.

If within a period of six months, the trial of the case is not completed, in that case, the ld. Trial court would pronounce its verdict on the basis of whatever materials have been collected in course of the witnesses being examined within the said period.

With the aforesaid observations, CRR 509 of 2024 is disposed of.

Pending application, if any, is also disposed of. The inspector in charge of Chopta P.S. is present in court. His further appearance before this court is dispensed with.

Report so submitted be kept with the record.
