In pursuance of the direction passed by this Court, a report is submitted by the learned Chief Judicial Magistrate, Malda indicating that during pendency of this appeal, the sole appellant/convict, Sk. Mohammad expired on 12.09.2019. A photocopy of certificate of death of the said appellant is annexed with the report, which also affirms the death of the said appellant.

4. As the sole appellant/convict, Sk. Mohammad has already been expired during pendency of this appeal, the instant appeal stands abated against him.

5. Accordingly, the instant appeal be and the same is hereby dismissed as abated.

6. Let a copy of this order along with TCR be sent down to the learned Trial Court immediately.
