A query was made by the court as to whether the petitioner was an employee of the State and would be covered by the service rules applicable to the employees of the State of West Bengal. Both Mr. Halder, learned advocate for the petitioner and Mr. Ganguly, learned senior government advocate along with Mr. Guchhait, have handed over notifications and the service book of the petitioner which indicate that the petitioner is an employee of the State of West Bengal.

As such, the reliefs which the petitioner has prayed for in this writ petition cannot be allowed, due to lack of jurisdiction.

The merits have not been gone into and the petitioner shall be at liberty to approach the appropriate forum in accordance with law.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
