C.R.R. No.471 of 2022 D/L28 June 14, Bpg.

In Re: An application under Section 483 of the Code of Criminal Procedure, 1973;

Cygnus Investments & Finance Private Limited

Versus

Nilasish Roy Mr. Anand Keshari, Mr. Sekhar Mukherjee, Mr. Gourav Kumar.

...for the petitioner.

The present application has been preferred for expeditious disposal of Complaint Case No.C/1672 of 2016 under Section 138 of the Negotiable Instruments Act pending before the learned Judicial Magistrate, 6th Court, Alipore. Learned advocate appearing for the petitioner submits that further cross-examination of PW 1 is yet to be completed. The case was initiated in the year 2016. Earlier, a coordinate Bench of this Court by an order dated 13.09.2019 in CRR 1961 of 2019 was pleased to direct that the proceedings should be concluded within a period of six months. However, due to COVID-19 the courts were operating in a staggered manner and, as such, I am of the opinion that the trial of the case could not be completed within the time as fixed by the co-ordinate Bench. Learned trial court is directed to adhere by the time period specified in CRR 1961 of 2019 and fix at least one date in a fortnight so that the trial can be completed within a period of six months from date. With the aforesaid observations, CRR 471 of 2022 is

disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
