Petitioner has filed this writ petition being aggrieved by inaction on the part of the respondent authority concerned in allowing it to file the appeal against the impugned order of adjudication by making pre-deposit of 10% of the disputed tax. Considering the facts and circumstances of this case and submission of the parties this writ petition being WPA 2840 of 2023 is disposed of by directing the respondent authority concerned to allow the petitioner to file the appeal against the adjudication order in question by making payment of 10% of the disputed tax in question as pre-deposit and after producing the challan for payment of the same to the authority concerned.

Such appeal has to be filed by the petitioner manually within two weeks and which will be accepted by the appellate authority concerned without raising the point of limitation if the same is filed within the time stipulated herein.
