Petitioner complains that his parking space is being blocked and as such he cannot comfortably neither park his vehicle nor ply his vehicle from the car parking space allotted to him by the society. It has been further submitted that the person who is blocking the car parking space happens to be a trespasser.

State has submitted a report. Report reflects that earlier Narendrapur PS Case No. 124/24 was registered on 05.02.2024 and upon completion of investigation charge sheet has been submitted and prima facie offences surfaced against one Arijit Dutta Gupta, respondent no. 8.

I find that the genesis of the dispute is relating to car parking which is giving rise to serious

breach of the peace in and around the vicinity of the address of the petitioner complained of accordingly. I direct the Officer-in-charge of the concerned police station to obtain the sanctioned plan from the designated office bearers of the society, assess as to how many legally allotted car parking spaces are available in accordance with the sanctioned plan which is existing and if there is any breach of the peace for illegal car parking, the police authorities without the permission from a civil court will not allow to park the car.

With the aforesaid observations WPA 3041 of 2025 is disposed of.
