The revisional application has been mentioned on the ground that the suit out of which the order impugned arises has been decided to be withdrawn by the parties and a memorandum of understanding has been filed in the learned court below.

Under such circumstances, the suit does not survive, as submitted by the learned advocates for the respective parties, and obviously the order impugned also does not have any effect.

The revisional application is dismissed as infructuous.

The copy of the memorandum of understanding is kept on record.
