Learned advocate appearing for the petitioners submit that they were unaware regarding the proceedings of Islampur P. S. Case no. 158 of 2023 dated 22-03-2023 and they have very recently come to know as the police authorities are after them. I have checked the records of the case and I find that the chargesheet has been submitted in connection with Islampur P. S. Case No. 158 of 2023 dated 22-03-2023.

The learned court after issuance of warrant of arrest and on receipt of the report of non-execution return was pleased to issue proclamation under Section 82 of the Code of Criminal Procedure.

Learned advocate for the petitioners submit that they intend to exhaust the remedy available under the law. Accordingly, the order issuing proclamation dated 04-07-2023 is stayed till 31st March, 2024. Learned Additional Chief Judicial Magistrate, Uttar Dinajpur will recall the order dated 4th July, 2023 and keep the

same in abeyance till 31st March, 2024.

If the petitioners do not appear before the court by 31st March, 2024, the learned Magistrate will issue the order of proclamation by adhering to the provisions of law under Section 82 of the Code of Criminal Procedure on 1st April, 2024. With the aforesaid observations, the revisional application being CRR 510 of 2024 is disposed of.

Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
