The petitioner complains that the Kolkata Municipal Corporation, despite conclusion of hearing, failed to pass and communicate any reasoned order in the matter.

Learned advocate appearing for the Corporation submits that hearing was conducted by the authorities of the Kolkata Municipal Corporation.

Copy of a document signed by the Chief Manager/Revenue (N), Kolkata Municipal Corporation dated 8th February, 2021 countersigned by the Deputy Assessor Collector (N), Assistant Assessor Collector and Assessment Collector, Division-IX all signed on 8th February, 2021 has been handed over in Court today.

It appears from the said document handed over in Court today that the order, if any, passed by the Kolkata Municipal Corporation was not communicated to the petitioner.

Accordingly, the present writ petition is disposed of by directing the Chief Manager/Revenue (N), Kolkata Municipal Corporation to communicate the fate of the hearing attended by the petitioner in response to the notice of hearing dated 25th May, 2017 at the earliest, but positively within a period of four weeks from the date of communication of a copy of this order. If the aforesaid respondent is of the opinion that a further hearing is required to be conducted to arrive at a proper decision, then the hearing shall be taken positively within a period of six weeks from the date of communication of a copy of this order and a reasoned order be communicated to the petitioner and all other necessary parties immediately thereafter.

Instruction given by the authorities of the Kolkata Municipal Corporation signed on 8th February, 2021 be retained with the records.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
