1. Affidavit-of-service is taken on record.
2. The petitioner submits that a transformer had been installed by the West Bengal State Electricity Distribution Company Limited on RS Plot No.1499 (sabek) corresponding to LR Plot No.1734 (hal) pertaining to Khatian Nos.4086 and 5447, mouza Chandrakana, J.L. No.103 under Police Station Chandrakana.
3. It is contended by the petitioner that another transformer, which is catering in the locality, was installed in the adjacent plot. The transformer which had been installed in the petitioner's land is lying unused. No connections had been effected from the same. The existence of the
transformer in an unused condition is causing difficulty to the petitioner for use and occupation of his own land.
4. The petitioner has already approached the authorities. Under such circumstances, the competent authority of the West Bengal State Electricity Distribution Company Limited, namely the Station Manager, Chandrakana Town Customer Care Centre, is directed to treat the writ petition as a representation of the petitioner and dispose of the same in accordance with law upon hearing the petitioner and if necessary any other interested parties.
5. A reasoned order shall be passed and communicated to the petitioner. If the transformer is not being used and is actually lying in the land of the petitioner, the same shall be removed.
6. The entire exercise shall be completed within a period of three months from the date of communication of this order.
7. A copy of the writ petition along with a server copy of this order be served upon the respondent No.3.
8. There shall be no order as to costs.
9. Parties are directed to act on the basis of the server copy of this order.
