Petitioner is directed to serve a copy of the revisional application upon Mr. Koushik Kundu, learned advocate who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned Authorities in due course. Learned advocate for the petitioner submits that the present case was initiated in the year 2019 and till date charge has not been framed. Learned advocate further submits that because of the non-availability of the Presiding Officer, the charge could not be framed in the month of June, 2023.

In view of the statement so advanced by the learned advocate for the petitioner, I direct that the learned trial court would take steps so that the charge is framed by September, 2023 or by 15th October, 2023. There are about 11 witnesses on whom the prosecution proposed to rely upon. Accordingly, the learned trial court after framing of charge would fix dates at regular intervals so that the trial of the case can be taken to its logical conclusion

within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties. In case any of the witnesses is absent, the learned court would seek the assistance of the Inspector-in-Charge/Officer-in-Charge of Durgapur Police Station for the purposes of serving of summons or notice. More than four years have passed since the initiation of the case. As such, efforts should be taken by the learned trial court to complete the trial which would commence from September, 2023 to end by September, 2025.

With the aforesaid observations, the present revisional application being CRR 426 of 2023 is disposed of. Pending applications, if any, are consequently disposed of.
