The learned advocate for the petitioner submits that till date the petitioner has not received the documents under Section 207 of the Criminal Procedure Code, relating to the charge-sheet filed in connection with Shibpur Police Station Case No.111 of 2023. Considering the stage at which the petitioner approached this court, I am of the view that the revisional application is premature. Accordingly, I grant liberty to the petitioner to canvass all the issues in the revisional application at the stage under Section 239 of the Code of Criminal Procedure before the learned Judicial Magistrate at the appropriate stage of the proceedings. Needless to mention that the learned Judicial Magistrate, Howrah, would independently assess the evidence without being influenced by any observation of this court while disposing of the revisional application.

Accordingly, the revisional application being CRR 514 of 2024 is disposed of.

All parties are to act on the basis of the server copy of the order.
