Learned Advocate appearing for the petitioner submits that the petitioner is in custody in excess of two years. He submits that the case is based on circumstantial evidence. Learned Advocate appearing for the State draws the attention of the Court to the postmortem report of the victim and to the fact that the weapon of the murder was seized from the possession of the petitioner on his leading statement.

Considering the gravity of the offence and the involvement of the petitioner therein and considering the postmortem report of the victim and considering the seizure list made from the petitioner on his leading statement, we are unable to grant bail to the petitioner.
