April 02, 2025 53 ARDR (Rejected) CRM(DB) 516 of 2025 In Re : An Application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Taherpur Police Station Case No. 42 of 2021 dated 5th March, 2021 under Sections 363/326/302/307/34 of the Indian Penal Code. And In Re :

Prahlad @ Prallad Barman ... Petitioner.

Adv. Shibaji Kumar Das, Adv. Nilanjana Sarkar ... for the petitioner.

Adv. Ranabir Roy Chowdhury, Adv. Diksha Ghosh, ... for the State.

The bail prayer of the petitioner was rejected on two earlier occasions on merits. The petitioner seeks bail on the ground of prolonged detention and slow progress in trial. Two out of seventeen charge sheeted witnesses have been examined. The petitioner is in custody for more than four years. Learned counsel for the State opposes the prayer for bail. This Court turned down the prayer for bail of the petitioner on two earlier occasions with an observation that the prima facie involvement of the petitioner in the crime has transpired from the material on record.

In view of the above, this Court is inclined to hold that there is no change of circumstance which warrants favourable order for the petitioner at this stage.

Accordingly, the prayer for bail is rejected at this stage. However, considering the period of detention of the petitioner, the learned trial Court is directed to take the proceeding to its

logical conclusion as expeditiously as possible without granting unnecessary adjournment to either of the parties, in accordance with law.

Case Diary be returned.

The application for bail is disposed of.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
